THE TERMS AND CONDITIONS OF SALE
Anyone wishing to book chauffeured car transportation services or VTC services from Avantgarde Limousines, for themselves or on behalf of duly authorized individuals, must unconditionally accept the following terms and conditions of sale. Any condition expressed by the client or passengers that contradicts the below general conditions will not be enforceable against Avantgarde Limousines, except in cases of prior written exception.


Avantgarde Limousines reserves the right to make modifications or adaptations to these general terms and conditions of sale at any time and without prior notice, in order to comply with legal regulations. However, the general conditions in effect at the time of the client's final confirmation of the service will apply to each service. The contracting parties in a service sale transaction carried out by Avantgarde Limousines must comply with all respective obligations detailed in these general terms and conditions of sale. Avantgarde Limousines, as a passenger transportation service, guarantees the proper execution and coordination of the assigned tasks to each of its clients.


I. RESERVATION 


Reservations can only be made by a legal adult who has the capacity to comply with the general terms and conditions of sale. The Client, as a contracting party, whether acting on their own behalf or on behalf of passengers, is responsible for providing accurate and authentic information during the reservation process.
No service can be provided without a prior reservation, which must subsequently be confirmed in writing. Reservations can be made in various ways: by phone, email, through the Avantgarde Limousines website, or any other methods permitted and approved by Avantgarde Limousines. A complete reservation must include the following information:
    • Date, time, and place of departure for the passenger(s)
    • Final drop-off location and any intermediate stops, if applicable
    • Number of people and luggage to be transported
    • Contact details of the passenger (phone, email, name)
    • Desired vehicle model or category

Avantgarde Limousines reserves the right to verify the client's payment capabilities when dealing with a new client.


II. RATES 


All services are subject to Avantgarde Limousines' pricing schedule, which is attached to the quote.
Rates may vary depending on market conditions, particularly during holidays, periods of high activity, or specific pickup and/or service areas.
The rates are inclusive of:
    • Chauffeur service
    • Fuel
    • Professional liability insurance for "paying passengers"
    • VAT at the rate set by the applicable regulations.
Unless explicitly stated otherwise in the quote, the rates do not include the cost of urban tolls, highway tolls, parking meters, parking fees, entry fees for public or private locations or sites, or chauffeur meals. These expenses will be charged for any service order lasting more than three hours.
The price stated in the quote provided by Avantgarde Limousines may be subject to revision to account for increases in fuel prices and any expenses incurred to ensure the proper execution of the service.
Additional fees may be charged for specific client requests, such as refreshments. The charged amounts will be detailed in the quote or upon confirmation of the reservation.
Avantgarde Limousines reserves the right to modify the pricing schedule at any time without prior notice. The client will be informed of these changes, which will only apply to all services once the pricing schedule has been updated accordingly.

OVERTIME OR DISTANCE SURCHARGE (EXCLUDING TRANSFER SERVICES
For any transportation service, Avantgarde Limousines may set a minimum charge, which will be subsequently included in the quote.
During a transportation service, there may be changes to the destination or an interruption of the service based on a client's request. In such cases, the client will be charged at least the predetermined flat rate specified during the reservation, taking into account the time and distance traveled.
Any overtime beyond the scheduled return time or additional distance traveled will be charged based on the current applicable rate specified in the pricing schedule.


III. SERVICE EXECUTION CONDITIONS


CLIENT PICKUP
The client(s) must comply with the rules established by Avantgarde Limousines. Failure to do so may result in the inability to provide the requested service, although Avantgarde Limousines cannot be held liable for such non-compliance.
All passengers must wear their seat belts, whether seated in the front or rear of the vehicle, to comply with traffic regulations. Avantgarde Limousines will not be held liable in the event of an accident if this requirement is not met.
All Avantgarde Limousines vehicles strictly prohibit smoking. A fee of 250 euros (including VAT) will be charged for any violation to cover the cost of a complete vehicle cleaning.
Furthermore, the consumption of alcohol is strictly prohibited in the vehicles. Avantgarde Limousines reserves the right to refuse any passenger who appears to be intoxicated or under the influence of drugs, as it poses a danger to the driver, the vehicle, or any other person.
Avantgarde Limousines retains the freedom to subcontract with a chosen third party without notifying the client.
Avantgarde Limousines cannot be held responsible if the vehicle and driver provided do not match the photographs on Avantgarde Limousines' website.
By accepting the general sales conditions, the client also consents to the geolocation system installed in each of Avantgarde Limousines' vehicles.

LUGGAGE POLICY
For safety reasons, any luggage exceeding the authorized limit determined by the vehicle's capacity cannot be accepted. Avantgarde Limousines will not be held liable for any lost luggage during or after the transportation service. Passengers are responsible for the supervision of their own luggage.

VEHICLE CAPACITY - NUMBER OF PASSENGERS TRANSPORTED
Each vehicle has a maximum capacity compatible with a certain number of passengers. Any passenger exceeding these limits may be refused by the driver or the transportation service agency.
PETS
Small pets are allowed in the vehicles, limited to two in number, weighing no more than 6 kg each, and must be enclosed in a container that meets the following dimensions: 45cmx30cmx25cm.

IV. RESERVATION MODIFICATION AND CANCELLATION

A reservation can only be canceled or modified if it is done at least 2 hours prior to the scheduled time of the service, directly with Avantgarde Limousines.
Avantgarde Limousines will invoice the service in its entirety or partially once the allotted time has been exceeded.

CONDITIONS APPLICABLE TO ALL SERVICES

Any reservation that has not been canceled 24 hours prior to the start of a service will be charged. This applies when the service incurs external costs for which Avantgarde Limousines is responsible.

CONDITION APPLICABLE TO ALL SERVICES PERFORMED IN SEDANS, MINIBUSES, AND VANS:

The client will be charged the higher amount between the transfer price from the pickup location and the time spent waiting for the client in case of cancellation less than two hours before the scheduled time or if the client is absent for one hour after the departure time.
This condition does not apply in the case of a reservation modification.

CONDITIONS APPLICABLE TO ALL SERVICES PERFORMED IN COACHES WITH MORE THAN 9 SEATS.

Any cancellation of service made less than two hours before the agreed departure time or any absence of the client one hour after the chosen time will result in the invoicing of the full amount of the initially agreed service. Additionally, this amount will be multiplied according to the following circumstances:
    • Between 72 and 48 hours before the start of the service: 10%
    • Between 48 and 24 hours before the start of the service: 50%
    • Less than 24 hours or No Show: 100%
During periods of high activity, specific cancellation or modification conditions may be applied by Avantgarde Limousines. These changes in conditions will be communicated in the quote or order summary received by the client.

V. DELAY

Avantgarde Limousines cannot be held responsible for any delays due to events beyond its control, such as strikes or flight delays.

DRIVER'S DELAY

A driver will be considered late if they do not arrive at the designated pickup location at the scheduled time. Avantgarde Limousines will notify you of the delay and offer an alternative in case of any impediments. However, if no alternative solution is available, compensation may be provided to the client, limited to the amount specified at the time of the reservation or a maximum of 150 Euros if the service amount could not be determined.

CLIENT'S DELAY

The driver is obliged to wait for the client for 1 hour at the meeting point. Once this time limit has passed, the client will be considered absent, and they will be charged the higher amount between the transfer price from the departure location and the time spent waiting for the client.

VI. COMMITMENT AND RESPONSIBILITY

Avantgarde Limousines is a chauffeur-driven transportation service agency that adheres to and implements all applicable professional rules. All chauffeurs of Avantgarde Limousines, whether they are owners or lessees, declare themselves responsible for the transportation vehicle as well as the safety of each passenger.
Regarding the passenger transportation service, Avantgarde Limousines declares itself the holder of a professional civil contract, including any pecuniary compensation for potential bodily, material, and immaterial damages that may occur in the event of a traffic accident where the passenger is not at fault. As such, Avantgarde Limousines is responsible for the passenger's safety from the moment they board the vehicle until their departure.
The chauffeurs of Avantgarde Limousines meet the client's requirements and possess the regulatory qualifications necessary to provide this passenger transportation service.

VII. DAMAGE

By accepting the general terms and conditions, the client accepts and assumes responsibility for any damage caused by themselves or the accompanying individuals, excluding the chauffeur. Therefore, if such damage occurs, it will result in an invoice for the necessary repair or assistance to restore the vehicle.

VIII. PAYMENT AND SUPPORTING DOCUMENTS

SERVICE PAYMENT TERMS

The accepted payment methods by Avantgarde Limousines are as follows: cash, credit cards (Visa, American Express, Diners Club, MasterCard), and bank transfers (sender's charges apply). During the reservation process, the client must provide the following mandatory documents:
    • Valid credit card details (including the CVV)
    • Copy of their identification card, passport, or equivalent document

In order to verify the validity of the provided credit card and the sufficient funds in the client's account to cover the service amount, Avantgarde Limousines reserves the right to charge a symbolic amount of less than 10 euros. Avantgarde Limousines may request the client's authorization for the total amount resulting from the provided services. The reservation and requested service by the client will be canceled if the credit card is invalid or if the account does not have sufficient funds.
A payment fee corresponding to 3.0% of the invoice amount will be charged for payments made with American Express.

INVOICING AND PAYMENT

Avantgarde Limousines will invoice the service on the date specified in the reservation. The final invoice will be sent to the client via email, including any additional fees or possible modifications. Once the service is completed, the client will be immediately notified of the debit for the provided service.

Avantgarde Limousines reserves the right to charge the amount for the previous day's service on a daily basis when it spans multiple days. The final amount will consider any previously invoiced services. If the client has a credit account, the payment for the service may be made upon receipt before the 15th of the following month, unless otherwise indicated.

DELAYED PAYMENT

In accordance with Article L441-6 of the French Commercial Code, a delay in payment will result in a request for a lump sum indemnity for administrative collection costs amounting to €40 (excluding taxes). Additionally, penalties will be charged at a rate at least three times the legal interest rate.
Furthermore, the aforementioned penalties will be applied without prior notice if Avantgarde Limousines is unable to debit the client's account.

CLAIMS

Any claim regarding the invoiced amount or the terms of service provision must be submitted by registered mail with acknowledgment of receipt to the address of Avantgarde Limousines. Furthermore, any written claim will only be considered if it is communicated within 8 days from the date of service completion.

IX. PERSONAL DATA

The Terms are subject to rules regarding the protection of personal data. Avantgarde Limousines collects a set of data during the reservation process and throughout the provision of transportation services. This data includes personal information allowing for the identification of the client (postal, telephone, and electronic contact details, payment methods) as well as that of the passenger(s) (email and telephone contact details). The collected data also includes information about the trips, speed in relation to the distance traveled, and vehicle location.

PURPOSES OF PROCESSING

The collection of this data by Avantgarde Limousines aims to enable proper management of service reservations and their confirmation, follow-up, and billing, as well as organizing any potential claims. It also serves to respond to incidents or accidents by making emergency calls and combating fraud. The gathered data also allows Avantgarde Limousines to maintain customer loyalty, conduct business analysis studies, and send commercial and advertising offers. However, the client's consent is essential before any disclosure of their personal data for the purpose of transmitting commercial information from other business partners. Thus, by accepting the general terms and conditions of sale, the client agrees to the collection and processing of their data for the aforementioned purposes, under the responsibility of Avantgarde Limousines.

DATA RETENTION

Starting from the date of reservation, Avantgarde Limousines retains the data related to the provided service for a duration of 3 years. All data may subsequently be kept by Avantgarde Limousines to comply with fiscal, accounting, and legal obligations. Avantgarde Limousines guarantees complete confidentiality and security of the collected data to its clientele.

CLIENT'S RIGHTS

The client has the right to access all data collected about them and, according to their preferences, make modifications or deletions of their personal data, restrict processing, request data portability, or object to the processing of their data for legitimate reasons.
For any request related to personal data, the client can send a letter to Avantgarde Limousines, along with proof of identity, enabling them to exercise their rights.

X. INTELLECTUAL PROPERTY

Except for use in compliance with the general terms and conditions of sale, the client may not use information, graphics, documents, photographs, or software belonging to Avantgarde Limousines and its partners, as they are subject to intellectual property protection. Without prior written authorization from Avantgarde Limousines, no reproduction or copying of elements from Avantgarde Limousines' website is permitted. This prohibition also includes any internet connection established through a hyperlink or otherwise related to Avantgarde Limousines' website.

XI. APPLICABLE LAW

Any contract executed by Avantgarde Limousines is declared to be in accordance with French law, as well as the aforementioned general terms and conditions of sale available on the website. In the event of any discrepancy between the French and English versions of the general terms and conditions of sale, the French version shall prevail. The English version is provided for informational purposes only. In case of any disagreement, the client may directly contact Avantgarde Limousines to address their claim amicably. However, if an amicable resolution is not achieved, the dispute will be subject to either the exclusive jurisdiction of French courts if the client is a consumer or the Nanterre Commercial Court if it involves a business conflict.
Furthermore, Avantgarde Limousines is a paid transportation service agency that operates under strict legal regulations, with only specific authorized vehicles. Unlike certain companies, we adhere to the regulations established for the transportation of passengers, ensuring complete guarantee for our clientele.
